These Terms of Use are a legally binding agreement between you (individually or on behalf of an entity) and Active Nomads LTD (“Active Nomads,” “we,” “us,” or “our”). By accessing or using www.activenomads.com and related media (collectively, the “Site”), you agree to these Terms.
We may update these Terms at any time. Changes will be indicated by updating the “Last updated” date. It is your responsibility to review these Terms periodically. Continued use of the Site signifies your acceptance of any changes.
The Site’s content is not intended for use in jurisdictions where it would be illegal or require registration. Users accessing the Site from such locations do so at their own risk and must comply with local laws.
The Site is for users aged 18 and older. Individuals under 18 are not allowed to use or register for the Site.

To be able to participate in Active Nomads retreats you must have a valid passport and be able to travel to our destinations independently. Flights are not included. Payments must be made in full, 45 days before the due date of the first day of the start date, at the most. Failure to complete all payments by the due date will result in loss of entry to Active Nomads Retreats, no refunds will be given.

We highly recommend holiday insurance for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand our cancellation policy before making a reservation. Please consider purchasing travel cancellation insurance.

By agreeing to these terms and conditions you are stating that:

• You have authorized to use the Debit/Credit card and/or PayPal account. 

• You will not charge back, dispute, or reverse any payments. 

• We reserve the right to ban any account/person without notice for any reason. 

• You have read the Terms & Conditions and agree. 
• You agree to be bound to the Terms and Conditions and everything listed above and below. No deposit refunds will be granted.

Booking Fee

A non-refundable $500 booking fee is required to secure your spot. Due to exclusivity and limited availability, deposits are non-refundable under any circumstances.

Guest Cancellation Policy

If you need to cancel your retreat, cancellation fees apply. All cancellations must be in writing. Any promotional inclusions will be deducted from refunds.

Refund Policy:

• Within 24 hours of booking: Full refund, including deposit.

• 120 days or more before start date: Full refund minus 5% admin charge (excluding non-refundable $500 booking fee).

• 120-90 days before start date: 50% refund (excluding non-refundable $500 booking fee).

• 60-90 days before start date: 25% refund (excluding non-refundable $500 booking fee).

• Less than 60 days before start date: No refund.

No refund for early departure or failure to arrive. Full booking cancellation required for partial guest cancellations. No refunds for room downgrades after 24 hours from booking.

For installment payments, the refund policy applies to the entire booking price. An additional 5% admin fee is charged on all installment payments. Full payment is due 45 days before the start date unless specified otherwise. Failure to pay by the deadline may result in forfeiture of the booking.

We reserve the right to cancel or postpone a retreat at our sole discretion. If we cancel or postpone a retreat, we will use reasonable efforts to reschedule the cancelled or postponed retreat to within twenty four (24) months from its original start date. Booking fees paid by guests for a cancelled or postponed retreat shall be applicable to the rescheduled retreat on a United States Dollars (USD) for United States Dollars basis only. 

Retreat venues, dates and locations are subject to change without prior notice. Active Nomads reserves the right to change any and all instructors for each retreat or event without notice. 

By registering for a retreat, you acknowledge that Active Nomads does not make any representation, warranty, or guarantee as to whether you will ultimately attain a cure for any health condition or disease.

If for any reason Active Nomads must cancel or change the Start Date of any retreat, for any reason whatsoever, you’re entitled to transfer the sums paid to another retreat (either scheduled or at some future time) to be used as credit. Alternatively, you may request a refund of payments made by you to the Company, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your Retreat.

Active Nomads is not responsible for your expenses incurred in preparation for any cancelled Active Nomads retreats such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

Use of credit or debit cards will not incur a surcharge if payments are cleared in full at the time of booking.

If the retreat must close, Active Nomads will inform you promptly and provide a full refund of the retreat cost. However, we will not cover flight costs.

You can pay for your retreat in up to 3 installments (booking fee and 2 maximum of 2 installments). A 5% administration fee applies to all installment payments.

You may change your booking week more than 90 days before the start date, subject to a $50 administration fee and any difference in room rates.

Guests may need to pay a city tax at checkout, calculated per person per night, for retreats located in cities.

Flights must be booked independently after confirmation of your retreat stay. Transfers outside our scheduled ones are available at an additional cost through our trusted 3rd party specialist. Provide your flight details at least a week before departure to ensure smooth transfer arrangements. Guests can arrange their own transport but note that costs may vary and there is a risk of getting lost or overcharged, especially since our retreats are often in remote areas

A refundable deposit of 10% of your booking will be charged. If you damage your room or any of the property within your room we will automatically deduct the cost of repairing / replacing / redecorating from this deposit.

If you feel unwell or are unhappy with the retreat, inform the Retreat or Hotel Manager immediately. Claims may be rejected if we are not given the opportunity to address issues during your stay.

For ‘share with unknown guest’ options, Active Nomads is not responsible for the actions or behaviors of your roommate. We ensure same-sex room shares unless otherwise specified.

Adding a guest to your booking is subject to availability and capacity limits. Confirm any changes as soon as possible to avoid disappointment. Places are only secured upon receipt of payment.

Sign a waiver at least 30 days before the retreat start date. If pregnant or under medical/psychiatric supervision, provide a doctor’s certificate confirming fitness to travel and participate. Our retreat is not suitable for those with psychiatric issues, children under 18, or individuals with severe physical disabilities. All health issues, including allergies, must be disclosed at booking.

Consult a doctor before participating in physical activities or treatments. Our team is not medically trained and cannot offer specific medical advice.

Information on our website and correspondence is accurate at publication but may change due to mechanical faults, weather, or other unforeseen issues. We will attempt to provide equivalent replacements, when possible, but cannot guarantee it. There will be no compensation for changes in team members or activities.

In case of team member emergencies affecting the retreat plan, we will adapt but may not find a substitute. The retreat will continue with adjustments. No refunds or compensation for changes in the team situation.

Active Nomads is not liable for:

• Events beyond our control.

• Loss, injury, or damage to you or your property.

• Physical, medical, or psychiatric conditions during or after your retreat.

Check that your holiday insurance policy covers these and other contingencies.

You agree to fully indemnify without
limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Active Nomads.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

By agreeing to these terms and conditions, you acknowledge your desire to participate in Active Nomads retreats and their activities, which may include exercises, yoga, pilates, training, running, cycling, and various other physical and therapeutic activities. You understand that participating involves risks of injury or even death. You confirm that you are voluntarily engaging in these activities and that Active Nomads Ltd is not liable for any injuries or losses that may occur during, after, or in transit to the retreat.
If you have any health conditions such as joint or back pain, high or low blood pressure, recent surgery, diabetes, heart conditions, or other significant health issues, you confirm that you have consulted a doctor or are accepting full responsibility for your health and acknowledge the risks involved.

The Site and its components, including code, designs, and content, are owned or licensed by us and protected by intellectual property laws. They are provided “AS IS” for personal, non-commercial use only. Unauthorized commercial use or reproduction is prohibited without our written permission. If you’re authorized to use the Site, you may access and print Content for personal use only. All other rights are reserved.

You grant Active Nomads the irrevocable and unrestricted right to use, republish, and copyright any photos or videos of you taken during the retreat for commercial purposes. You release Active Nomads from any claims or demands related to the use of these images, including those for libel or invasion of privacy.

We prioritize data privacy and security. By using the Site, you agree to our Privacy Policy, which is part of these Terms of Use. The Site is hosted in the United States. If you access it from a different region with different data protection laws, you consent to having your data transferred to and processed in the United Kingdom and Ghana.

These Terms of Use remain effective while you use the Site. If your account is terminated or
suspended, you are not allowed to create a new account under your name, a false name, or a third party’s name, even if you are acting on their behalf. We also reserve the right to take legal action, including civil, criminal, and injunctive measures.

We reserve the right to change, modify, or remove content on the Site at any time without notice. We are not obligated to update information on the Site and may also modify or discontinue any part of the Site at our discretion. We are not liable for any modifications, price changes, or interruptions. We cannot guarantee the Site will always be available and may experience issues or require maintenance, which could lead to disruptions. You agree that we are not responsible for any losses or inconveniences resulting from downtime or site changes. Nothing in these Terms of Use requires us to maintain or support the Site or provide updates or corrections.

The Site may contain typographical errors, inaccuracies, or omissions, including issues with descriptions, pricing, and availability. We reserve the right to correct these errors and update the information on the Site at any time without prior notice.

By using the Site, sending emails, and completing online forms, you consent to receiving electronic communications. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement for written communication. You also agree to use electronic signatures, contracts, orders, and other records, and to receive electronic notices, policies, and transaction records. You waive any rights or requirements for original signatures or non-electronic records under applicable laws.

These Terms of Use, along with any posted policies or rules, represent the entire agreement between you and us. Failure to enforce any right or provision does not waive that right or provision. We may assign our rights and obligations to others at any time and are not liable for any loss or damage caused by factors beyond our control. If any part of these Terms is found to be unlawful or unenforceable, it will be severed without affecting the rest of the Terms. These Terms do not create a joint venture, partnership, employment, or agency relationship. They will not be construed against us due to their electronic form or lack of physical signatures.
Active Nomads is a smoke-free and alcohol-free retreat, except where specifically agreed for BESPOKE services. Smoking (including e-cigarettes and vaping) is only permitted in designated areas outside the villa and retreat. Guests found smoking or inebriated on the property may be asked to leave without a refund. Alcohol found on the premises will be confiscated and returned at check-out. Recreational drugs are strictly prohibited, and guests under the influence of drugs will be asked to leave without a refund.
This contract is governed by the laws of the United Kingdom and Ghana. By agreeing to these terms and conditions, you confirm that you are acting on behalf of yourself and any other parties included in your booking. By making a booking, you agree to comply with and be bound by all policies and rules.
